We’ve not been told David Hicks will probably face some sort of trial ‘early next year’… some 5 years after his detention by bounty hunters whilst waiting for a bus home.
The reason trials can go ahead is because President Bush has signed new legislation which not only allows the trials to go ahead, but also permits what is euphmistically terms ‘tough interrogation techniques’ for detainees.
The American Civil Liberties Union today calls the legislation “one of the worst civil liberties measures ever enacted in American history”. Other than permitting toirture, it effectively makes impossible any habeus corpus appeal to the courts , disallows any recourse to the Geneva Convention, and permits convictions based on hearsay evidence and coerced testimony.
In effect someone could be coerced under torture to say they heard two people talking about someone else and that testimoney would be acceptable as confirmation of guilt!
This is what the Americans call justice?? Go figure.
